Message strategy for defense in court. I got pulled over for the car backfiring when I made the 1-2 shift, and the car seems to do this often. The cop knew he could not get me for anything else, so he wrote me this "unnecessary sound" ticket, which in the Oregon lawbook talks about any sound a vehicle that makes that is not needed for its operation. The cop said, "you made it backfire", and I told him "no", but we are going to court this Thursday. Here is what I think....

1. I can/did not make the car backfire.
2. My HKS Hiper exhaust is pretty aggressive looking, but is still 100% street legal, and he had a hard on for this.
3. The car has a JWT ecu, which I imagine as part of its programming would tend to run the car a bit rich, with the boost jets (15 psi) to keep from a lean condition. This rich fuel mixture could allow unburned gases to ignite, causing a random backfire. Am I right on this, and if so, where would be a good source of this to quote? (JWT?)
4. The cop lost in a prior court case to me, and is on the verge of harassing me, at least so it seems. He was a real prick and tried to talk down to me, but was largely unsuccessful. When I told him he was wrong about me "speed racing up the block, and making the car backfire", he responded with a childish "Mr. Cronin, are you a lawyer?". He is going to lose in court again, I am afraid.....

What do you guys think about this bullshit? Sorry for the long post....
